Post Oak Savannah Groundwater Conservation District

On January 30, 2003, President Bush committed the US to the ITER Project, an international project to build a working Fusion reactor within 10 years. Fusion is the same process that the Sun uses and relies on deep sea water as a fuel. While there are no guarantees, this project gives us a chance that two or three generations from now, electric power can become really cheap. That simple change in the price of electricity could allow future Burleson County farmers to economically irrigate all of their land, with huge agricultural productivity gains.

Making sure that there is water in Burleson County for such future enterprises is the responsibility of the Post Oak Savannah Groundwater Conservation District (POSGCD). They are in the middle of trying to get a set of rules adopted and are learning that big money, big business, surplus groundwater, and "the public" are an interesting mix!

FINAL RULE MAKING STATUS

PUBLIC HEARING ON FINAL RULES - March 9 (Election Day!) 2004

The POSGCD wants your opinion on all these new and wonderful things:
  • The latest version of the RULES! (including February Changes not made public till now!)
  • The Official Forms that are part of the rules and greatly affect how much hassle drilling a well will be.
  • The FEES that the board will be charging us to drill any kind of well.
  • The Management Plan on how they are going to take care of us for the next decade.
Of course, most of this has not even been seen by the public unless it is included in this weeks newspaper. AND, if you want to tell the Board your opinion, you'll have to go to the Milam County Courthouse, 100 South Fannin, in Cameron at 5:30pm to have your say!

OH! Don't forget to vote! You have to do that before 7pm and if you want to attend your party's caucus (usually starts just after 7pm) the driving will get interesting!

Even if you plan to attend the Hearing, I suggest you e-mail them your comments at POSGCD@tconline.net or fax them to (512)455-9909. It won't get them in the official record, but you may do just as well by telephoning the individual Board Members and telling them what you think! It appears that they really don't think we have anything useful to say since passing all of this is also on the meeting's agenda and can be done immediately after the hearing!

Second Public Hearing - June 28th, 2003

Comments On Draft Rules and Regulaltions made at the Board's 2nd Public Hearings are availabe here as we can get copies from the presenters or the POSGCD staff.

The current rules were approved for public hearing based upon the changes round of public comment. Received comments have been reviewed by the Rules Committee on April 24, 2003 and again on May 05, 2003. The rule committee presented their changes to the full Board at the May 13, 2003 regular monthly meeting.

First Public Hearing - March 20th through April 19th, 2003

POSGCD has issued the Comments On Draft Rules and Regulations which is a "draft" official compendium of all comments received during the March 20th through April 19th, 2003 (initial) Public Comment period. Just click on the title to go to an index of them and see who really said what!

Now is the time to lobby the POSGCD Board Members to ensure that the rules do what you want. You can be sure that big industry is doing exactly that, so don't feel bashfull! Here are some ways to contact them:

POSGCD OFFICIAL DOCUMENTS

The rest of this page attempts to provide facts about the conservation district and what it is doing. The following sections are the actual documents creating and regulating the district and the in-work and official material which has been generated by the district.

Groundwater Availability Modeling (GAM)

The POSGCD Board has adopted the use of the Groundwater Availability Modeling or "GAM" simulation to estimate the impacts of groundwater pumping within the District. The reference is Run 8 of the "Final GAM Runs" dated January 3, 2004, available here as an Adobe Portable Document Format (*.pdf) document. (I am trying to find a write-up to help interpret the data!)

Management Plan

The POSGCD Management Plan is a strategic document describing the overall objectives of the District and the means by which it will achieve those goals. It is also available for download in its original MS Word format or in Adobe *.pdf format.

Minutes of Board Meetings and Press Releases

The POSGCD holds its regularly scheduled Board Meetings starting at 5:30 p.m. on the second Tuesday of each month. The location usually alternates between Milam County and Burleson County, but the locations vary. Check the Agenda for the date you are interested in attending!

We are attempting to keep all of the Meeting Notices, the Official Minutes of the Board's meeting and the more informal "Press Releases" describing most of their meetings and public education activities in the following table, organized by the actual meeting or event date. Legislative Documents

Groundwater has always been and is still a big subject in Texas and there are lots of legislative rules written and then re-written over lots of years that one has to wade through. If you have your waders on, we will try to provide the documents!

The Post Oak Savannah Groundwater Conservation District gets its powers from and is subject to the restrictions and requirements passed by the Texas Legislature. Finding all the documents affecting the POSGCD is probably a long work in progress, but here is what has been identified to date:

  • HB-1784, passed in the 77th Legislature (2001) is the enabling legislation. Articles 1 and 3 create the Post Oak Savannah Groundwater Conservation District in Burleson and Milam counties, subject to a confirmation vote of the county voters. The District received that confirmation vote in both Burleson and Milam counties as part of the November 5, 2002 fall general election.

    Articles 2 and 4 create the Brazos Valley Groundwater Conservation District (Brazos and Robertson Counties) and Mid-East Texas Groundwater Conservation District (Leon, Madison, and Freestone Counties) respectfully. To make reading easier for Burleson and Milam county residents, these sections have been moved to seperate documents. Click on the hyperlinked place-keeper in the main document to read them.

    Article 5 sets up the "Carrizo-Wilcox Coordinating Council", a super-board to coordinate (and essentially take over) many of the functions of the individual districts, but only if all the Districts choose to implement it. This super-board is now essentially dead since both the Lost Pines Groundwater Conservation District (unknown date) and the Post Oak Savannah Groundwater Conservation District (Jan. 14, 2003) have passed resolutions refusing to join the council. These resolutions must be confirmed at the first annual regional coordination meeting held under Sections 2.08, 3.08, and 4.08 of this Act to have final effect.

    Article 6 handles adminstrative functions and provides that this document will override any conflicting provisions of Senate Bill 2 also enacted by the 77th Legislature.

  • Texas Water Code, Section 36 "Groundwater Conservation Districts". is a primary reference. Where it and HB-1784 differ, it is HB-1784 that is used.
  • Texas Water Code, Section 32 "Water Well Drillers" also affects the District's relationship with Water Well Drillers.
  • Texas Administrative Code, Chapter 76 "Water Well Drillers and Water Well Pump Installers" are the specific rules which implement the legislation in Texas Water Code, Chapter 32. We also have a better looking Adobe Portable Document Format (*.pdf) version Here.
  • Texas Local Government Code, Chapter 232 "County Regulation of Subdivisions". is referenced in the Texas Water Code in determining if a well may be exempt or not.
  • Senate Bill 2 also passed in the 77th legislature and makes selected changes to much of the legislation referenced above.
